1. Data Protection
AXA recognises that protecting personal information, including sensitive personal information, is very important
to you and that you have an interest in how we collect, use and share such information. AXA, as Data Controller,
invites you to review this Data Protection Notice & Privacy Statement, which outlines how we use and protect your
information and information provided by third parties (such as your named driver(s) and people who live with you in an insured property).
Rest assured that AXA will use every effort to protect your personal data and we will not sell your personal information
to any third party companies. Furthermore, all personal data we gather will be processed in accordance with all data protection
laws and principles and in compliance with any code(s) of practice issued by the Office of the Data Protection Commissioner.
References to "AXA" and "we" mean AXA Holdings Ireland Limited and its subsidiaries, including AXA Insurance dac, and any associated companies from time to time.
The information that you provide to AXA will be held on a computer, computer database, e-mail, imaged documents, paper files, telephone recording, CCTV footage,
letter and/or in any other way.
You should show this notice to anyone insured to drive the vehicle covered under your policy and/or anyone
living at the property insured under your policy as it also applies to them.
You have the right to access the personal data holds about you by AXA by sending a written request to the
Compliance Department, AXA Insurance dac, Wolfe Tone House, Wolfe Tone Street, Dublin 1 together with
payment of a fee of €6.35 / £5.00. You also have the right to require AXA to correct any inaccuracies in
the information we hold about you. It may take up to 40 days (from the date of receipt of the completed request) to process your request.
The 40 days will not start until we receive a completed request from you (or your authorised representative).

By taking out a policy of insurance with AXA you explicitly consent to the processing of your personal or
sensitive data as set out in this Data Protection Notice & Privacy Statement.
Where we require personal or sensitive data relating to persons other than you (such as other drivers named on your motor
insurance policy and/or persons living with you at your insured property) it is important that you have their consent to the processing
by AXA of such personal or sensitive data as set out in this document. By taking out a policy of insurance you are confirming that you
have obtained the consent of such other persons to the processing of their personal and sensitive data as set out in this Data Protection Notice & Privacy Statement.
We shall not disclose personal information without the consent of the individual to whom it relates except in limited
circumstances as permitted or required by law.
The personal data we require about you (and, if applicable, your named driver(s) and the people who live with you in an insured property)
will be gathered and stored as set out in this Data Protection Notice & Privacy Statement in order to properly service your insurance needs.
Such gathering and storing will be carried out either directly, by AXA staff or via the various AXA websites, or indirectly, through one of our service providers.
When gathering personal data, AXA or our service providers (as the case may be) may:
obtain personal information directly from you, your named driver(s) or the people who live with you in an insured property (either verbally,
in writing or via the AXA Drivesave application (see paragraph 6 below));
obtain personal information from third parties involved in an incident in which you and/or anybody insured under your policy of insurance are involved,
including (without limitation) other drivers, passengers of your or any other vehicle, pedestrians, witnesses (whether independent or otherwise),
other insurance companies, solicitors representing any third party (whether in civil or (where applicable) criminal proceedings), any other expert appointed
by a third party, any person at any relevant case, trial, inquest or any other hearing, or any other relevant person involved in the claims process;
- carry out credit searches with one or more licensed credit reference agencies; and/or
carry out searches (whether online via websites with publicly available information or various industry specific websites), through various media outlets
(including, without limitation, television or radio) or otherwise (including, without limitation, State and/or industry registries)); and/or
- from the Gardaí (in very limited circumstances).
We may request details about you or any insured driver under your contract of insurance (motor policy) and/or any person residing in the insured premises
(household policy) regarding your or their health, any medical conditions which may affect your or their ability to drive and/or the commission of, alleged
commission of or conviction for any relevant offence by you or any insured driver covered under the contract of insurance and/or any person residing in the insured premises.
If AXA asks you or anybody insured under your policy of insurance to provide medical information during the sales process, in the course of dealing with a claim
or at any other time, please do not send us the results of any genetic tests carried out on you or such other person.
4. Use of information
AXA will use the information it gathers:
- to verify the information we receive;
assess your insurance needs and to assess the nature and level of the risk associated with your proposed insurance policy to determine
your eligibility and (if you are eligible) your premium;
to make decisions regarding deferred payment arrangements, including without limitation whether to continue or to extend an existing deferred payment arrangement;
- to administer and process any products/services you have purchased from us, including any future agreements with us;
- to manage and investigate any claim made by or against you or anybody insured under your policy of insurance;
- to provide customer loyalty programmes and value added services (for example the AXA Plus scheme);
- to carry out market research and statistical analysis;
- to market other AXA products from time to time (where you have consented to same);
- for staff training, performance reviews & discipline and the review and improvement of AXA's processes & systems;
- for the detection and prevention of fraud and to assist the Gardaí, or any other authorised investigatory branch of the State, with any inquiries or investigations;
- to manage and investigate any complaints;
- for reinsurance and (where necessary) AXA Group reporting purposes;
- for compliance with regulatory, legal and tax laws and regulations; and/or
as otherwise set out in this Data Protection Notice & Privacy Statement or any other data protection notice,
policy booklet or other policy document provided to you by AXA or your broker.
AXA may use credit scoring and other automated decision making systems. Where we use automated decision making which produces legal effects for you or otherwise
significantly affect you, we will enable you to make representations in relation to the decision in question.
Where you have obtained a quotation but not purchased an insurance policy and where you have consented, we may retain your personal data for 15 months after the date
of the quotation in order to provide you with a further quotation for the insurance product you have enquired about, as well as the other purposes set out in this
Data Protection Notice & Privacy Statement.
In certain limited circumstances, we or a service provider may be required to transmit your personal data outside the European Economic Area
(including, without limitation, to the USA). If this is required we will ensure that such transmission is carried out in accordance with data protection law.
By supplying a vehicle registration number AXA will conduct a search of third party databases (including, without limitation, the Motor Insurance Anti-Fraud
and Theft Register ("MIAFTR"), the National Vehicle File, Insurance–Link, Risk Intelligence Ireland Limited and the Claims and Underwriting Exchange Register
which will return information relating to you and your vehicle, including (without limitation) previous claims, vehicle write off history, NCT/MOT, vehicle
modifications and vehicle taxation and import status as part of your normal quotation process.
MIAFTR is operated by the Association of British Insurers in the UK. MIAFTR logs all insurance claims relating to written-off and stolen vehicles in the UK
and the service is used to prevent vehicle fraud and assist with the location of stolen vehicles.
The National Vehicle File is a database containing details of all registered vehicles in the Republic of Ireland. The database is maintained and supported
by the Department of Transport, Tourism & Sport and is central to the processing of motor tax in Ireland.
By supplying an eircode and/or an address of a property when you are taking out an insurance policy, you are consenting to AXA conducting a search of a third party
database to determine location based risk factors (called geocoding). This search will return information relating to the topographical nature of the area in which
your property is located as part of the normal insurance quotation process. This information is used to support us in rating your risk level when providing you with
During any of the activities set out above, a department of AXA may become aware of information which should have been disclosed at inception of your policy/policies
or at a previous renewal which relates to you and/or anybody else insured under your policy of insurance. For the avoidance of doubt, where this occurs such department
shall be entitled to share such information with the Sales and/or Underwriting Departments for the purpose of providing your next quotation and/or deciding whether or
not to cancel your policy/policies or with the Claims Department for the purposes of deciding how to deal with a claim.
5. Sharing of information
Where we choose to have certain services provided by carefully selected third parties, we do so in accordance with the applicable law and we take precautions regarding the
practices employed by the service provider to ensure your personal information is kept securely.
In such circumstances we may share your personal data, including sensitive personal data (such as data relating to your health or any relevant criminal convictions),
with agents, service providers or expert witnesses (including but not limited to motor repairers, motor engineers, car hire companies, loss adjustors, tradesmen,
solicitors/barristers, medical practitioners, various specialist claims investigation service providers, translators (if required), research companies, etc.)
or private investigators appointed by us or our agents.
Where a claimant is making a claim against you for which AXA is providing an indemnity, AXA shall be entitled, where we feel it is necessary, to release such information
to the claimant, their solicitor or such other appropriate representative of the claimant to allow them to make an application to the Injuries Board or to issue legal
proceedings. Such information shall generally (but not exclusively) be limited to your name, address and vehicle registration number and the name and address of any
relevant people who are insured under your policy of insurance (including, without limitation, any other driver insured under your contract of insurance).
6. Specific Service Providers
In addition to the information set out above, we would also like to draw your attention to some additional information relating to a number of the services
we use which involve the sharing of your personal data:
i. Credit searches and use of third party information
In assessing your application for insurance we may search files made available to AXA by credit reference agencies (including but not limited to County Court
Judgments in Northern Ireland, details from the electoral register and information from CIFAS, which is a UK database on fraud) who may keep a record of this search.
We may also pass credit reference agencies information we hold about you and your payment record. The information will be used by other credit lenders for making
credit decisions about you and the people with whom you are financially associated for reasons including, without limitation, fraud prevention, money laundering
prevention and for tracing debtors.
We may ask credit reference agencies to provide credit scoring computations. Credit scoring uses a number of factors to work out risks involved in any application.
A score is given to each factor and a total score obtained. Where automatic credit scoring is used by us, acceptance or rejection of your application will not depend
only on the results of the credit scoring process but may impact your premium.
ii. Penalty Point Information
AXA may access accurate data from the Department of Transport, Tourism & Sport in the Republic of Ireland and the Driver and Vehicle Licensing Agency (the "DVLA")
in Northern Ireland on driving convictions and penalty points (including without limitation the number and reasons for same) when we are providing quotes for motor
insurance policies. By requesting a quotation for motor insurance you consent to AXA using your driving licence number and/or the driving licence numbers of all
drivers named on your policy for the purpose of determining your eligibility and (if you are eligible) your premium to so contact the Department of Transport,
Tourism & Sport or the DVLA. This consent includes use of your and/or your named drivers' licence numbers to so contact the Department of Transport, Tourism &
Sport or the DVLA for your current policy of insurance and for the renewal of your policy in every subsequent year for which you are an AXA policyholder.
Such searches may be carried out in an automated manner.
iii. AXA Drivesave
AXA DriveSave is our insurance telematics product. AXA DriveSave is a system by which your driving performance is monitored and
used to calculate your insurance premiums. The information gathered by this system may also be used by AXA when dealing with any claims in which you and/or your
vehicle are involved. Not all motor policies have this feature; check your Policy Schedule to see if it applies to you.
Under the AXA DriveSave system certain technical information relating to your driving performance is collected, stored and
analysed for AXA by a third party service provider, MyDrive Solutions Limited (UK) ("MyDrive").
MyDrive (on behalf of AXA) collects and analyses details of your location, speed, acceleration and braking severity through an app on your mobile phone
(formerly on a permanently installed device in vehicles). This information is collected on a second-by second basis and analysed to determine and rate various
aspects of your driving behaviour.
If you have this policy feature you may be eligible for a cash-back discount on your premium for good driving (as determined by AXA and MyDrive at their sole discretion).
However, AXA may (at its sole discretion) cancel your insurance policy, in addition to any other rights we may have under the terms of your policy, if we determine
(at our sole discretion) that you or any other driver insured under your insurance policy are driving dangerously. In this event you may find it difficult to
arrange appropriate insurance in the future.

iv. Insurance-Link in Republic of Ireland
What is Insurance-Link?
The Insurance-Link database has been created by the Irish Insurance Federation and the self-insured claims task force to assist their members in the detection and
defence of exaggerated and fraudulent claims. It contains details of claims made by individuals against insurance policy holders or directly against self-insured
members of the service. It is run by Risk Intelligence Ireland Limited, Unit 15, Trinity Technology and Enterprise Campus, Pearse Street, Dublin 2. Information
(including further contact details for Risk Intelligence Ireland Limited) on Insurance-Link is available on www.inslink.ie.
How does AXA use the Insurance-Link database?
Where you get a quotation or take out an insurance policy with us, we will check the details you have supplied with the Insurance-Link database.
Where a claim is made against your policy, we will pass details of the claim (including name, address, date of birth and the type of injuries or losses suffered)
to the Insurance-Link database. This information is available to other insurance companies through the Insurance-Link database.
At both inception of your policy and where any claims are made by or against you, we will also check the Insurance-Link database for information on any previous claims
made by you and, if applicable, any third party claimants. In the event that we find any undisclosed claims we will then contact the relevant insurance company to
obtain details of such claims.
v. Registers in Northern Ireland
In Northern Ireland Insurers pass information to the Claims and Underwriting Exchange Register, run by the Insurance Database Services Limited, and MIAFTR,
run by the Association of British Insurers. The main aims are to help insurers to check information provided and to prevent fraudulent claims. When we deal with
your request for insurance or any claims made by or against you, we may search these registers.
Northern Irish law requires that certain information relating to insured vehicles must be entered on the Motor Insurance Database ("MID"). It is a condition of your
policy that you supply AXA with such details of the vehicles whose use is covered by the insurance policy so that we may enter the relevant information on the database.
The policy details of customers in Northern Ireland will be added to the MID, run by the Motor Insurers' Bureau. MID data may be used by the Driver and Vehicle Licensing
Agency for the purpose of Electronic Vehicle Licensing and by the Police for the purposes of establishing whether a driver's use of the vehicle is likely to be covered
by a motor insurance policy and/or for preventing and detecting crime. If you are involved in an accident (in the UK or abroad), other UK insurers and the Motor Insurers'
Bureau may search the MID to obtain relevant information relating to you and your insurance policy.
Persons pursuing a claim in respect of a road traffic accident (including citizens of other countries) may also obtain relevant information which is held on the MID.
In circumstances where you are involved in an incident (such as accident or theft), it is also a condition of your policy that you must tell us about such an incident,
whether you feel it may give rise to a claim or not. When you tell us about such an incident, we will pass relevant information relating to the incident to the
Claims and Underwriting Exchange Register, MIAFTR and any other official register set up for the purpose of checking information and preventing fraud.

7. Communication with customers
It is envisaged that we may contact you from time to time in relation to various aspects of your dealings with AXA. This contact will relate to the purposes set out in or
referred to in this Data Protection Notice & Privacy Statement and may include (without limitation):
- the administration of your insurance policy;
- in connection with customer loyalty programmes and value added services you have signed up to;
- to discuss the renewal terms of an existing policy;
- in connection with a claim or complaint;
- marketing or to offer you a quotation for a motor, home or other insurance policy (where you have consented to such contact);
- to discuss a quotation already provided (where you have consented to such contact); or
- to conduct customer surveys (where you have consented to such contact).
Other than at your request, we will not make calls to you before 9am or later than 9pm Monday to Saturday, or at all on Sundays, bank holidays / public holidays.
8. Telephone recording
We may record or monitor telephone calls (for the duration of the call) in order to ensure accuracy in the communication of instructions to us, to facilitate staff training,
for the prevention of fraud, for management of complaints and to improve customer satisfaction. Our recordings shall be and remain the sole property of AXA.
9. Other products and services
From time to time AXA may want to contact you to offer you other products and services which are similar to those you have purchased,
including those available from companies in the AXA Ireland Group and (occasionally) carefully selected third parties, which AXA thinks may be of interest to you.
Such marketing information may be provided to you by post, email, telephone (including, without limitation, by mobile telephone) or SMS.
10. Information automatically logged
Our site will record unique information from your computer such as your IP address, user agents and referring address.
We monitor this information:
- To help find problems on our website.
- To help to administer our web site.
- To help to identify unique users of services.
- To help gather broad demographic information to help us improve our site.
